1.INTRODUCTION
This partner agreement is an electronic record in terms of Information Technology Act, 2000 (Act) and rules thereunder, as applicable and is published in accordance with the requirements of the Act and the rules notified thereunder. This partner agreement is generated by a computer system and does not require any physical or digital signatures. By listing your offering on this Platform, it is deemed that you have consented to the terms and conditions set out herein and are bound by the terms and conditions set out herein.
The use of the Platform is offered to you conditioned on your acceptance of all the terms and conditions contained in this partner agreement. You hereby further agree that this partner agreement is being concluded and executed in the State of Karnataka.
All partners are requested to carefully read the terms and conditions set out herein for the listing of their products and services on the Platform which is owned and operated by Bliv Spaces Private Limited, a company incorporated under the laws of India with its office at BLIV Spaces Pvt Ltd. REVA NEST. REVA UNIVERSITY, Bengaluru 560064.
In this policy, the term ‘Platform’ refers to www.bharatklub.com and the bharatklub application as listed on the google play store and app store; the terms ‘we’ or ‘our’ or ‘us’ refer to Bliv Spaces Private Limited (‘BLIV Spaces’), the company owning and managing the Platform; the term ‘you’ or ‘your’ refers to the partner who registers on our Platform for listing their products and services and the term ‘Parties’ refers to Bliv Spaces and the partner collectively.
2. TAX AND COMPLIANCES
We shall in no manner be liable for any payouts, charges, fines, liabities, taxes etc. associated with the goods and services listed on our Platform and all such costs and liabilities shall be borne by the owner or provider of the goods and services.
In respect of the real estate related properties listed on our Platform, the partner confirms that with respect to the property listed on the Platform, all applicable laws, including laws relating to land use, building regulations, environment, fire safety, pollution control, health and sanitation, property, and related taxes, etc. have been complied with, and that all necessary approvals and permits in relation to the property have been obtained. All taxes related to property ownership, parking and other matters shall continue to be borne by the partner.
3. LIABLITY
The partner hereby recognises that we are solely an intermediary, connecting the user with the partner and shall in no manner whatsoever be responsible for the obligations of the partner or the user or the usage of the goods and services listed on our Platform.

In respect of the real estate properties listed on the Platform, the partner hereby acknowledges and understands that the partner shall be solely liable and responsible for the condition, wear and tear of the property listed on our Platform and any issues arising on account of the occupation and use of the property by the end user including any breach of the leave and license agreement or any other documents executed between the user and the partner.

We shall not be responsible or accountable in any manner whatsoever in respect of the actions or omissions of the user or the partner in respect of the usage or occupation of the property.

All costs in respect of the occupation of the property such as stamp duty and registration costs shall be borne by the partner and occupant in the manner agreed between them and we shall not be liable for such costs in any manner whatsoever.

4. GOVERNING LAW AND DISPUTE RESOLUTION

This agreement will be governed by the laws of India. Courts of Bangalore, Karnataka shall have exclusive jurisdiction for any disputes arising under this Partner Agreement.

5. ENTIRE AGREEMENT

This agreement along with any other written contract executed between us and the partner, shall constitute the entire understanding on the listing of the goods and services by such partner on our Platform and shall supercede any other oral discussions in this regard.

6. TERMINATION

Notwithstanding the above, Service Provider may terminate this agreement and any other contract in writing executed with the partner in case of any breach of the terms and conditions of such contracts by the partner or occurrence of fraud or gross negligence by the partner.
